EYEVERSE TERMS OF SERVICE

OVERVIEW
These Terms of Service (“Terms”) govern your use of the EYEVERSE website and your purchase of EYEVERSE products and services. Throughout these Terms, “EYEVERSE,” “we,” “us,” and “our” refer to EYEVERSE.
By visiting our website, placing an order, booking a session, uploading content, or using our services, you agree to these Terms, our Privacy Policy, Return and Refund Policy, and Shipping Policy.
If you do not agree to these Terms, please do not use our services or place an order.
1. ELIGIBILITY
You must be at least 18 years old to place an order or enter into an agreement with EYEVERSE.
A parent or legal guardian must provide consent and a signature when a submitted human photo includes anyone under 18 years old.
By submitting an order, you confirm that the information you provide is accurate and that you have legal authority to enter into this agreement.
2. OUR SERVICES
EYEVERSE creates customized artistic products using customer-submitted iris, eye, pet-eye, and personalization information.
Our services may include online written guidance, photography assistance, image review, artistic editing, personalized artwork, digital files, prints, frames, accessories, packaging, and promotional gifts.
EYEVERSE provides an artistic photography and design service. Our services are not medical examinations, biometric identification services, health assessments, or diagnostic services. We do not diagnose or treat any medical condition.
3. ORDERS AND PAYMENT
All prices are shown in U.S. dollars unless otherwise stated.
An order is not accepted until payment has been successfully processed and you receive an order confirmation.
We may cancel or refuse an order because of suspected fraud, an obvious pricing or product-listing error, unavailable products, incomplete information, inability to fulfill the requested customization, violation of these Terms, or another legitimate business reason. If EYEVERSE cancels a paid order before providing products or personalized services, we will return the applicable payment to the original payment method.
Your Shopify order number and the email address or telephone number provided to EYEVERSE may be used to verify your purchase before allowing booking or photo uploads.
4. CUSTOMER-SUBMITTED PHOTOS AND INFORMATION
You may submit photos, names, dates, personalization details, testimonials, and other content necessary for your order (“Customer Content”).
By submitting Customer Content, you confirm that:
• You own the content or have permission to submit and use it.
• The content does not violate another person’s privacy, copyright, trademark, publicity rights, or other legal rights.
• All submitted information is accurate.
• You have obtained the required permission from every person shown in the submitted content.
• A parent or legal guardian has provided consent when a human photo includes a minor.
You authorize EYEVERSE and its necessary service providers to securely store, review, crop, edit, enhance, reproduce, and process Customer Content only as reasonably necessary to create, fulfill, deliver, and support your order.
Submitting photos for order fulfillment does not automatically give EYEVERSE permission to use them for advertising.
We will use submitted photos, finished artwork, a customer’s first name, a pet’s name, or a testimonial on our website, portfolio, social media, or advertising only when the customer gives separate marketing permission. Refusing marketing permission will not prevent the customer from purchasing or receiving an order.
5. MINORS
If any submitted human photo includes a person under 18, the submitting adult must identify themselves as the minor’s parent or legal guardian and provide their full name, consent, and signature.
We may reject or delete a minor’s photo if required guardian authorization is missing, incomplete, inconsistent, or cannot reasonably be verified.
6. PHOTO QUALITY AND CUSTOMER RESPONSIBILITIES
Customers must follow EYEVERSE photo instructions and submit original, clear, properly focused images.
If a submitted image is blurry, cropped incorrectly, heavily compressed, contains excessive reflections, or does not show sufficient iris or eye detail, we may request another photo.
The customer is responsible for responding to retake requests and supplying required information within a reasonable time. Production and delivery estimates may be delayed until acceptable photos and complete personalization information are received.
EYEVERSE is not responsible for errors caused by incorrect names, dates, spelling, order details, measurements, selections, addresses, or photographs supplied or approved by the customer.
7. CUSTOM AND PERSONALIZED PRODUCTS
EYEVERSE products are made or personalized specifically for each customer. Natural artistic differences may occur because of photo quality, screen calibration, printing processes, materials, lighting, cropping, handmade production, and supplier manufacturing.
Colors displayed on a screen may differ slightly from colors in a printed or physical product.
Once design, editing, production, printing, engraving, or personalization has started, an order generally cannot be changed, canceled, returned, or refunded unless the product is damaged, defective, incorrect due to our error, or a refund is otherwise required by law.
By placing an order for a customized or personalized product, the customer acknowledges that the product is created specifically for them and becomes final sale after personalized work begins, as explained in our Return and Refund Policy.
Please review all names, dates, spellings, options, shipping information, and personalization details carefully before submission.
8. PRODUCTION AND THIRD-PARTY SUPPLIERS
EYEVERSE develops the artistic concept, customization, and customer experience. Independent service providers may assist with printing, manufacturing, packaging, payment processing, hosting, shipping, or fulfillment.
Physical materials, finishes, and construction may vary according to the specific product description and available production options. We do not guarantee an unlisted material, wood type, metal, gemstone, or manufacturing method.
EYEVERSE remains the customer’s point of contact for problems with an EYEVERSE order.
The use of a production, fulfillment, or shipping provider does not remove any responsibility EYEVERSE has to the customer under these Terms, our published policies, or applicable law.
9. SHIPPING AND DELIVERY
Production and shipping estimates are estimates unless we expressly guarantee a specific date.
Customers are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address or refused delivery may be charged to the customer where permitted by law.
If we cannot ship merchandise within the time stated at purchase—or within the period required by applicable law—we will provide any legally required delay notice and offer the customer the applicable option to accept the delay or cancel the unshipped merchandise for a refund.
Shipping-carrier tracking and delivery records may be considered when investigating a delayed, lost, or allegedly misdelivered package, but they will not eliminate any rights or remedies that cannot legally be waived.
10. RETURNS, REFUNDS, CANCELLATIONS, AND DAMAGED ORDERS
Returns, refunds, cancellations, damaged items, incorrect items, and missing items are governed by our Return and Refund Policy.
Customers should inspect delivered products promptly and report damaged, incorrect, defective, incomplete, or missing items within 7 calendar days of confirmed delivery so that the issue can be investigated promptly. This reporting period does not limit any non-waivable rights available under applicable law.
Claims should include the order number, a description of the problem, photographs of the product, photographs of the shipping package and label, and any other information reasonably necessary to investigate the claim. An unboxing video may be provided when available but is not required if other reasonable evidence is available.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
11. PROMOTIONS AND COMPLIMENTARY GIFTS
Promotions and complimentary gifts are subject to the specific eligibility rules, deadlines, availability limits, and instructions published with the promotion.
A promotional gift:
• Is available only while supplies last.
• May be limited to qualifying products or a stated number of customers.
• Has no cash value and cannot be exchanged for cash.
• Is not part of the purchased product unless expressly stated otherwise.
• Does not make the customer’s paid customized order eligible for cancellation or refund.
When a promotion is limited to the first stated number of qualifying orders, eligibility will be determined by EYEVERSE’s order records and the specific terms published with that promotion. Cancellation or unavailability of a promotional gift does not cancel or alter the customer’s paid order unless applicable law requires otherwise.
EYEVERSE may reject fraudulent, duplicate, altered, or otherwise ineligible promotional claims. Social-media sharing, posting on a personal timeline, or tagging friends will not be required where prohibited by the applicable platform’s rules or applicable law.
12. PRODUCT SAFETY
Some products or packaging may contain small parts, jewelry components, cords, electronic components, batteries, glass, crystals, or decorative materials.
These products are not toys. Keep them away from babies, young children, and pets. Children must use or handle products only with responsible adult supervision.
Customers should stop using any item that becomes damaged, broken, loose, sharp, overheated, or otherwise unsafe.
13. INTELLECTUAL PROPERTY
The EYEVERSE name, logos, branding, website content, original designs, graphics, product presentations, photographs created by EYEVERSE, and other intellectual property owned by EYEVERSE may not be copied, reproduced, modified, sold, distributed, or commercially used without written permission.
The customer retains ownership of their original submitted photographs. EYEVERSE retains ownership of its pre-existing design elements, templates, methods, branding, and creative systems.
Unless otherwise stated in writing, purchasing customized artwork gives the customer a personal, noncommercial right to display and enjoy the delivered artwork. It does not transfer EYEVERSE trademarks, templates, production files, or commercial resale rights.
14. PROHIBITED USES
You may not use our website or services to:
• Violate any law or regulation.
• Submit content you do not own or have permission to use.
• Infringe another person’s privacy or intellectual property rights.
• Upload malicious code or attempt unauthorized access.
• Commit fraud or submit false payment, identity, order, or promotional information.
• Harass, threaten, exploit, or harm another person.
• Resell, copy, or commercially exploit EYEVERSE designs without written authorization.
15. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website and services are provided on an “as available” basis.
We do not guarantee that every submitted photo will be suitable, that every artistic result will appear identical on every screen or material, or that the website will always operate without interruption.
Any warranties, rights, or remedies that cannot legally be excluded remain unaffected.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, EYEVERSE will not be liable for indirect, incidental, special, or consequential damages resulting from use of the website, customer-supplied errors, unauthorized submissions, events outside our reasonable control, or misuse of a product.
Nothing in this section excuses EYEVERSE from providing a legally required shipping-delay notice, cancellation option, refund, replacement, or other non-waivable consumer remedy.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
17. PRIVACY
Our collection, use, retention, disclosure, and deletion of personal information and submitted photographs are governed by our Privacy Policy.
Marketing permission is separate from the permission required to process and fulfill an order.
18. CHANGES TO THESE TERMS
We may update these Terms when our services, products, technology, business practices, or legal obligations change.
The version posted on our website at the time an order is placed will generally govern that order, except where a change is required by law.
19. GOVERNING LAW
These Terms are governed by the laws of the State of California and applicable United States federal law, without limiting any mandatory consumer protection rights available to the customer.
20. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
